To answer pertained query we need to take reference of section 2 (n) of Factories Act which defines occupier as one who has ultimate control over the affairs of the factory. It further says that in the case of a company which owns a factory, a Director can be the occupier of the company, because an occupier is responsible for the overall control of the factory administration.
