Factory manager can be the occupier of the factory under Factories Act?

Dear All, Today we are going to discuss two questions under Factories Act, viz. a)        Whether factory manager can be the occupier of the factory? b)        Whether the Board can nominate any officer of the company as occupier to have control over the affairs of the company? To answer pertained query we need to take reference of section 2 (n) of Factories Act which defines occupier as one who has ultimate control over the affairs of the factory. It further says that in the case of a company which owns a factory, a Director can be the occupier of the company, because an occupier is responsible for the overall control of the factory administration. Hence, the Factories Act prescribed only a director to be the occupier.
