To answer this, we need to take reference of sub section (5)
of section 1 of the Employees Provident Funds and Miscellaneous Provisions Act,1952
(EPF and MP Act 1952) which states that ‘an establishment to which Act applies,
its applicability provision shall continue notwithstanding that the number of
person employed therein fall below twenty’.
Furthermore, in the event of no employee in establishment,
still compliance will be required to be continued in the manner prescribed in
the law.
To conclude this, we can say that, to get relief in this
regard, it will be only in the case of cessation of establishment by notifying
closure intimation.
